Terms & Conditions
1. Acceptance
By accessing or using HisabKitab ABC ("the Platform") operated by ABC Accounting & Business Consultants ("ABC"), you agree to these Terms & Conditions. If you do not agree, do not use the Platform. Where the Platform is deployed for a client ("Customer"), use is additionally governed by the master services agreement between ABC and the Customer.
2. Licence & Access
ABC grants you a limited, non-exclusive, non-transferable, revocable licence to use the Platform for lawful business accounting. The demo "Sovereign Gateway" login is a presentation gate only; access controls (RBAC tables, API key generators) are interface conveniences, not security guarantees — protect the device accordingly.
3. Nature of the Service (Client-Side Only)
- The Platform runs entirely in your browser; records persist in localStorage on your device.
- There is no server-side backup or redundancy. You alone are responsible for exporting/backing up data (Central Data Hub · Master Backup).
- Clearing browser storage, device loss/failure, or profile resets permanently destroys local data. ABC bears no responsibility for such loss.
4. Financial Figures & Compliance
Tax computations (PAYE bands, NAPSA 5%, NHIMA, VAT 16%, WHT, Zakaat nisab), exchange-rate conversions, IFRS-styled statements and audit dashboards are computational conveniences. They are not a substitute for professional accounting, audit, tax, or legal advice. Statutory filings remain solely your responsibility before ZRA, NAPSA, NHIMA, PACRA and other authorities.
5. Your Obligations
- Enter accurate, lawful data; do not process data you are not entitled to hold.
- Keep your device secure; restrict access to the browser profile using the Platform.
- Do not misrepresent Platform output as externally audited financial statements.
6. Intellectual Property
The platform design, code, modules, branding (HisabKitab, ABC logos) and templates are the property of ABC. You receive a licence to use them; source code remains ours. Your business data remains yours.
7. Warranties & Liability
The Platform is provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law, ABC is not liable for indirect, incidental, consequential or special damages, including lost profits, lost data, tax penalties, or business interruption. Aggregate liability, if any, is limited to fees paid for the licence in the 12 months preceding the claim.
8. Termination
Access may be suspended for breach of these Terms. On termination, export your data first — local copies remain under your control.
9. Governing Law
These Terms are governed by the laws of the Republic of Zambia. Disputes are subject to the exclusive jurisdiction of the courts of Lusaka, Zambia.
